Rental Terms and Conditions

These regulations govern the rental of Icon Rent Bellagio Vespas. Please read these terms carefully before proceeding with your vehicle reservation.

RENTAL TERMS & CONDITIONS — ICON RENT S.R.L.
(website version, to be shown at the time of booking)

By booking a Vespa with ICON RENT S.R.L. you declare that you have read and
accepted the following rental conditions. The rental agreement will be signed
when you collect the vehicle.

1. SUBJECT AND DELIVERY
The vehicle (Piaggio Vespa Primavera 125) is handed to you in excellent condition,
fully working, with a full tank, two certified helmets, an anti-theft device and
documents. At pick-up you declare that you have examined the vehicle and accept it
without reservation. The rental transfers to you only the physical custody of the
vehicle; ownership and possession remain with ICON RENT. You may not transfer the
use of the vehicle to third parties for any reason.

2. HIRER REQUIREMENTS
Rental is reserved for persons aged 16 or over holding a valid driving licence for
the vehicle (category A1, A or B), not suspended, revoked or expired. Minor hirers
(16–17) must also have the agreement signed by a parent or legal guardian, who
assumes joint and several liability for all obligations. You undertake not to
provide false information regarding identity, age, address or driving requirements.

3. HIRER'S OBLIGATIONS
You undertake to: drive the vehicle personally, wearing a fastened certified helmet
and ensuring any passenger does the same; keep the vehicle with the utmost care,
always using the anti-theft device when parked; comply with the Highway Code; not
subject the vehicle to excessive speed or stress; immediately report any fault,
anomaly or accident, however minor; return the vehicle in order, with the same
accessories, documents and fuel level as at delivery, normal wear excepted; pay any
fines issued during the rental and related handling costs; reimburse any expense
(including legal costs) incurred to obtain performance of the obligations,
authorising charges to the credit card indicated.

4. PROHIBITED USES
It is strictly forbidden to use, or allow the use of, the vehicle: by any person
other than the hirer; to carry persons or goods for reward; to push or tow; in
races, competitions or trials; under the influence of alcohol, drugs or any
substance impairing driving ability; for unlawful purposes; outside Italian
territory; in restricted or port/airport limited-traffic zones; off-road, on
trails, mule tracks or unpaved roads. ICON RENT may refuse the rental or demand
immediate return of the vehicle in case of improper use.

5. SECURITY DEPOSIT
As security for the obligations, a € 300 deposit is taken at pick-up via credit-card
pre-authorisation (or cash). It is released within 12 days of returning the vehicle,
once the absence of damage, shortages or breaches has been ascertained. It may be
retained, in whole or in part, to cover damage, penalties, insurance excesses,
shortages, appraisal costs, loss of keys or documents and any other amount due.

6. INSURANCE AND EXCESS
The vehicle carries third-party liability insurance (RCA). The following remain
payable by you: the insurance excess per claim; damage to the vehicle not covered
by the policy; damage arising from prohibited use or breach of these conditions,
which voids coverage. Optional covers (theft/fire, kasko) apply only if expressly
taken out.

7. LIABILITY FOR DAMAGE
You are responsible for the vehicle from delivery until return certified by ICON
RENT. You shall compensate any damage to the vehicle, its parts and accessories,
plus administrative and appraisal costs, unless third-party liability is
established. The amount, based on the spare-parts price list and the supplier's
estimate, is charged to your credit card, which you expressly authorise. You are
also liable for damage from incorrect refuelling, unauthorised repairs and tyre
punctures (repair or replacement).

8. ACCIDENTS
In case of accident you must: immediately inform ICON RENT at +39 348 7093141;
alert the competent Authority where necessary; not make statements of liability
where the dynamics are uncertain; record names and addresses of parties and
witnesses; send a detailed CID report within 24 hours; cooperate with ICON RENT and
its insurer in any investigation or proceeding. The rental fee remains due for the
days the vehicle is unavailable following the accident.

9. THEFT, FIRE, LOSS OF KEYS AND DOCUMENTS
In case of theft or fire, total or partial, you must immediately report it to the
competent Authority and deliver the original report to ICON RENT within 24 hours.
In the absence of theft/fire cover, or where it is void (including failure to return
the keys), you pay the market value of the vehicle at the time of the event, plus
the rental fee up to the date of the report. Loss or theft of keys or documents
triggers the penalties in Art. 11, plus replacement/duplication costs.

10. RETURN OF THE VEHICLE
The vehicle must be returned at the agreed place, date and time, during opening
hours and into the hands of ICON RENT staff. Parking the vehicle outside the rental
point is not a valid return. A 30-minute tolerance applies; beyond it, one full
additional rental day is charged. Failure to return the vehicle without prior
notice, or without justification due to exceptional circumstances, will be treated
as misappropriation/theft and reported to the Judicial Authority; in such case ICON
RENT is authorised to charge the full value of the vehicle to the card provided,
plus rental days accrued until recovery, recovery costs and damages for
unavailability.

11. PENALTIES
You undertake to pay the penalties and charges listed below, which are in addition
to any compensation for damage:

- Helmet not returned (each): € 120.00
- Loss of key: replacement cost + € 80.00 penalty
- Missing fuel: missing litres at € 2.60/l + € 15.00 penalty
- Fines / penalties: the fine amount + € 30.00 handling fee
- Technical damage appraisal: the appraisal amount + € 100.00
- Extraordinary cleaning: € 40.00
- Return after the agreed time: one full daily rate
- Loss of registration document: duplication costs + € 50.00

12. BREAKDOWNS
In case of technical breakdown not attributable to the hirer that prevents use of
the vehicle, ICON RENT will, where possible, replace it with a similar one; where
impossible, it will refund the unused part of the rental. Nothing further is due by
way of damages. Abandonment of the vehicle obliges you to reimburse all recovery
costs.

13. SEIZURE OF THE VEHICLE
In case of seizure or administrative detention for causes attributable to you, you
pay the daily rate for the entire period of unavailability until release, up to the
market value of the vehicle, plus costs and fines.

14. EXCLUSION AND LIMITATION OF LIABILITY
To the extent permitted by law, ICON RENT is not liable to the hirer, passengers or
third parties for damage of any kind, direct or indirect, arising from use of the
vehicle, breakdowns, accidents, delays in delivery, unforeseeable circumstances or
force majeure, nor for loss of or damage to items left on the vehicle, which are
deemed abandoned.

15. PAYMENTS
The rental is paid in advance upon delivery, by credit card or cash within legal
limits. Booking is confirmed by a deposit (caparra confirmatoria) equal to 50% of
the price; in case of cancellation by the customer the deposit is retained under
Art. 1385 of the Italian Civil Code. Late payments bear interest at the ECB rate
plus three percentage points.

16. TERMINATION
ICON RENT may terminate the agreement with immediate effect, under Art. 1456 of the
Italian Civil Code, in case of breach of articles 2, 3, 4, 5 and 10, demanding
immediate return of the vehicle; in such case only the unused portion of the rental
is refunded, without prejudice to the right to retain it against ascertained damage.

17. GOVERNING LAW AND JURISDICTION
The agreement is governed by Italian law. Any dispute is subject to the exclusive
jurisdiction of the Court of Monza, without prejudice to the mandatory consumer
forum where applicable under Legislative Decree 206/2005.

18. FINAL CLAUSES
Any amendment must be in writing and signed by both parties. The invalidity of
individual clauses does not affect the others. For anything not provided herein, the
Italian Civil Code applies.


APPROVAL OF CLAUSES (Arts. 1341-1342 Italian Civil Code)
By booking, you declare that you have carefully read and specifically approve the
clauses in articles 2, 3, 4, 5, 6, 7, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18,
governing requirements, prohibited uses, deposit, excesses, liability for damage,
penalties, exclusion of liability, termination and jurisdiction.


PRIVACY NOTICE (Art. 13 EU Reg. 2016/679 — GDPR)
The data controller is ICON RENT S.R.L., registered office at Via Moncenisio 4, 20900 Monza (MB), info@iconrent.it. Personal data (identity, contact, ID, licence, payment
data) are processed for: (a) performance of the contract and pre-contractual steps;
(b) legal, tax and accounting obligations; (c) protection of the controller's
rights, including claims, fines and debt recovery; (d) with optional consent, direct
marketing. Provision of data for purposes (a)-(c) is necessary: refusal makes the
rental impossible. Data may be disclosed to insurers and adjusters, payment
providers, public and judicial authorities where required, and the controller's
accountants and lawyers; they are not disseminated nor transferred outside the
European Union and are kept for the duration of the contract plus 10 years
(marketing data until consent is withdrawn). You may exercise your rights under
Arts. 15-22 GDPR (access, rectification, erasure, restriction, portability,
objection) by writing to info@iconrent.it, and lodge a complaint with the Italian
Data Protection Authority (Garante).
